MEDICAL CANNABIS PATIENTS PROTECTED UNDER FLORIDA LAW

EMPLOYEE PROTECTION FOR OFFSITE CANNABIS USE UNDER FLORIDA LAW

If the Florida Court accepts the interpretation from other established cases (Headley vs City of Miami;Young vs Progressive Southern Insurance Company) then an employer can not discriminate againts off-site use of medical cannabis. An emplyer would not be able to take an adverse action against an employee for merely testing positive for THC. Instead, the employer would need additional evidence that the employee was actually impaired while on-site.
