2026 Recreational Ballot Initiative Status
The high-profile “Adult Personal Use of Marijuana” constitutional amendment failed to qualify for the November 2026 ballot after falling approximately 100,000 signatures short of the 880,062 required.
Current Appeal: The sponsoring group, Smart & Safe Florida, is challenging this finding,claiming they submitted over 1.4 million signatures and that state
officials improperly invalidated tens of thousands of petitions.
Legal Hurdles: Even if the signatures are restored, the proposal faces opposition from the state’s Attorney General, who argues the language is misleading.

Card Extension & Fees
Extends card validity from one to two years and slashes renewal fees for
veterans (from $75 to $15).

Opioid Alternative
Allows patients prescribed Schedule ll Opiods (like OxyContin) to

Parental Rights
Prevents denial of child custody or visitation solely
because a parent is a registered MMJ patient.
Operational Changes for 2026
License Expansion: The state is expected to
finally issue 22 New Dispensary Licenses in 2026, following the
resolution of long-standing legal challenges.
Revocation Rules: Starting July 1, 2025, the
Office of Medical Marijuana Use (OMMU) gained authority to revoke patient registrations for
certain serious drug convictions, a policy that will be actively enforced
throughout 2026
